This is a software issue and bmw should take a note of this and update the software in the next patch.

Here is the sequence, if there is no physical keys nor phone key with me and I unlock the car by using the card key on the driver side door, then I open the tailgate, the tailgate will open however the tailgate automatically motorized open and close function is disabled and I have to manually open and close the tailgate. AND the disabled tailgate will not return to normal by itself even if I go grab the physical key and come back to start and stop the car. In order to get the tailgate function back to normal I have to reboot the iDrive system by holding the volume button and the physical key or phone key will have to be with me.

In rare case like this that I have forgot my phone at the desk and went out to grab something from the trunk with just the card key in my wallet, I was about to call my dealer to have my car looked at but luckily the reboot worked.

Anyone also noticed that the tailgate will not close if the car is on an upward slope ? gerts 3/4 closed and moves back up as if it's hit something - cars been in 3 times to correct no luck so far

That I have not noticed but rather the tailgate motor is on the strong side where I had to put some muscle in in order to stop it from opening to hit the garage door
